Sub: Effective date for  implementation of Revision in the Operational Guidelines of the Market Access Initiative (MAI) Scheme as per Minutes of the Empowered Committee Meeting held on 4th May 2023 - Reg.

 

Greetings from Pharmexcil!

 

In continuation to Pharmexcil circular PXL/HO/Cir-029/2023-24 dt: 17.07.23w.r.t amendments regarding MAI claims for reimbursement of expense incurred on statutory compliance abroad, Pharmexcil has sought the clarification on the effective date for implementation of revised provisions from the Dept of Commerce.   

 

Department of Commerce vide OM K-11020/74/2023-E&MDA- DoC dt: 07.11.2023 has specified that 26th June 2023 would be the effective date of implementation of Minutes of the Empowered Committee Meeting held on 4th may 2023. Accordingly, for all the MAI claims filed by Exporters to Pharmexcil from 26th June 2023, the following two provisions would apply

 

  1. 90 days’ timeline for submission of MAI claims by Exporter to Pharmexcil
  2. Limitation of reimbursement to the exporters having f.o.b value of exports up to Rs. 100 crore during the preceding financial year.
  3. Applicants have to submit the Chartered Accountant Certificate w.r.t FOB value of Exports during the preceding FY along with GST returns filed during the preceding year.

 

Members are advised to take note of the revisions in the operational guidelines and submit their claims on-line accordingly.

 

Kindly note that, as per the Clarification given by the Dept of Commerce, all the MAI claims submitted to the council from 26 th June 2023 by the exporters having f.o.b value of exports greater than Rs. 100 crore during the preceding financial year will not be meeting the eligibility criteria of the revised MAI guidelines and hence will be returned back.
