Narcotic Drugs and Psychotropic Substances (Regulation of Controlled Substances) Order, 2013

Enclosed herewith Notification dated 26th March, 2013 on the subject, which is sent by the Dept. of Pharmaceuticals as directed by the Ministry of Finance (Dept. of Revenue) to take note by all concerned, of the changes and necessary actions as mandated in the notification.

 

Summary on some of the important points:

 

·      No person shall manufacture, distribute, sell, purchase, possess, store, or consume any controlled substance included in Schedule-A without a unique registration number in Form-A issued by the Zonal Director of Narcotics Control Bureau, except those exempted; the requirement of registration shall be complied within 180 days of the order coming into force and be made in Form-B to the Zonal Director of Narcotics Control Bureau having jurisdiction over the area.

·    Every person who has been registeredunder sub-clause (l) shalt maintain daily accounts in Form-C or Form- D; the records of the daily accounts shall be preserved  for a minimum period of five years from the date of last entry and shall file quarterly return in Form-E or Form-F before the last day of the month following that quarter; shall immediately report any loss or disappearance of the controlled substance in Schedule-A to the concerned Zonal Director of Narcotics endorsing a copy to the Director General, Narcotics Control Bureau, New Delhi.

·        A Registration no. holdermay surrender his registration, if so desires, giving notice in writing to the issuing authority and obtaining acknowledgement; the stocks in possession on surrender, shall be disposed of in a manner as specified by the issuing authority in this behalf.

·        Transport of the substances in Schedule-A:  No consignment shall be moved in India from one place to another place without a consignment note in Form-G;  The original and duplicate copies of the consignment note prepared in triplicate, shall be sent to the consignee along with the consignment, who shall return the duplicate copy to the consignor after endorsing the quantities received on the original and duplicate copies; In case of non-receipt of duplicate copy, consignor shall report loss or disappearance of the consignment within 45 days from the date of despatch of the same.  If the consignment dispatched comes into the jurisdiction of another Zonal Director of the Narcotics Control Bureau, the consignor shall send a quarterly report to such Zonal Director in Form-H.

·        Sale of the controlled substance in Schedule-A: No person shall sell to a buyer who does not possess a valid registration number except to a buyer without a registration no. as specified in 2nd proviso to sub-clause(1) of clause 4.

·    Destruction of the controlled substance in Schedule-A:  Any person intends to destroy the substance, shall apply in Form-I to the concerned Zonal Director who shall appoint a Committee within 30 days of receipt of the same and authorized representative of the applicant, to carry out destruction within 30 days of the appointment of the committee.

·      Export of controlled substance in Schedule-B:  No personal shall export controlled substances in the absence of “No Objection Certificate” from the Narcotics Commissioner; Shall apply to Narcotics Commissioner in Form-J to obtain No Objection Certificate to export the substance and the No Objection Certificate issued shall be valid for a single consignment only. Every exporter shall submit the details and documents as required to the Narcotics Commissioner within 7 days of export.

·         Import o controlled substance in Schedule-C: No person shall import any substance in the absence of No Objection Certificate from the Narcotics Commissioner and anyone who wants to import the substances shall apply to the Narcotics Commissioner in Form-K., who shall issue or deny the No Objection Certificate within 21 working days of the receipt of the application, and which shall be valid for only one consignment. Every exporter shall submit the details and documents as required to the Narcotics Commissioner within 7 days of import
