Sub: REVISED TIMELINES (45 DAYS FOR CLAIMING INCENTIVES UNDER MAI SCHEME)s
Dear Sir / Madam,
This is to inform the members that the Empowered Committee of MAI held on 05.10.2021 has deliberated on the Timelines for submission for MAI claims by the exporters to EPC (Export Promotion Council i.e Pharmexcil) and the timelines for EPC for processing & recommendation to the Dept of Commerce (DoC). It is decided by the Empowered Committee that
· The time-limit for submission of the claims by exporters to EPC is reduced to 45 days (from the existing 90 days) from the date of receipt of registration.
· It is further stated that the EPC can take maximum of 45 days for processing of claims & submitting eligible claims to the DoC.
Thus the exporters have to submit their MAI claims with complete information/documents within 45 days from the date of Registration Certificate for reimbursement of expense incurred towards statutory compliances in the buyer country (i.e Product registration charges, Patent Filing Charges, Plant inspection charges, Bioequivalence studies charges, Quality certification of Natural products, Implementation of Bar coding on exports etc.)
Pharmexcil is required to give a certificate stating that the claim is received with complete information within 45 days from the date of Registration Certificate while forwarding the claim with its recommendations. Claims received after 45 days will not be considered by the Ministry as per the Empowered Committee decision.
Members are advised to take note of this important change in the guidelines and file their claims within 45 days with complete documentation.
Claims pertaining 2020-21 and 2021-22:
· The Empowered Committee further directed the EPC (Pharmexcil) to process and recommend the MAI claims submitted by the members in the past i.e Claims pertaining to 2020-21 & 2021-22 to the DoC within 45 days from the date of issue of minutes of EC held on 05.10.2021.
It is observed that many of the applicants are required to submit shortfall documents for the MAI claims initiated online. In view of the direction of the Empowered Committee, we request the applicants to submit the shortfall documents on-line for the claims pertaining to 2020-21 and 2021-22 latest by 20th October 2021.
Further the hard copies (Pre-processed claims) are required to submit to the Council latest by 23rd October 2021. In case of non-receipt of the shortfall documents within the given timelines, the applications will be returned without further notice.
It may be noted that the Ministry is very particular about timelines and not entertaining any requests for condonation of delays. Hence, members are advised to follow the times lines strictly and avoid rejections/ returns of their claims.
