Dear Sir/Madam,

 

Subject: Extension of issue of Certificate of Origin (CoO) from 60 days to 180 days under India-Chile PTA in case of emergency - regarding.

 

You are kindly aware that India shares a Preferential Trade Agreement with Chile signed on March 8, 2006 which was expanded from May, 2017.

 

"As per para 15(5) of India-Chile PTA, the certificate of Origin shall not be issued  before the date of the issue of the commercial invoice relating to the consignment,  but may be issued on the same date or within the following sixty days".(Copy enclosed)

It has been brought to notice that many exporters are unable to file for issuance of Certificate of Origin (CoO) within the stated time frame as mentioned in India-Chile PTA due to global lockdown arising out of COVD – 19 pandemic.

The Department of Commerce is analyzing the situation and further intends to request for extension of timelines with Chile side for issuance of Certificate of Origin from 60 days to 180 days under India-Chile PTA. This would further aid member companies in claiming preferential rates under India-Chile PTA.

Member companies facing difficulties in producing Certificate of Origin due to laps of 60 days are requested to submit their issues along with the justification in the  format attached herewith to enable the Department to frame a concrete proposal.

 The requested information shall be sent to rodelhi@pharmexcil.com with a copy to dgdesk@pharmexcil.com positively by 9th July 2020.
