Issues Related Patents Violations in Europe |

Sub: Issues Related to EU Regulations on Patent Violations - Reg.
Further to our circular dated 7th Dec.2008 on the above subject, members are aware of rigid implementation of local patent rules of European Union in the recent past. Our Council has been alerting our members that pharmaceutical products exported from India, being transshipped through European ports are being seized under patent protection laws in Europe. This is being done in Europe through the products in transit or not meant for European markets and are also not protected for patents in the countries of destination.
In view of the seriousness of the problems, Pharmexcil would like to take up the matter with the Ministry of Commerce & Industry for appropriate action with the European Authorities.
Members are therefore requested to urgently inform us of any incidents of seizures of their exports under European patent laws at the European ports. Members may send us the details urgently in this regard, to enable us to take up the matter with expeditiously with the Government.
